IN ARBITRATION, THERE IS NO JURY, LESS DISCOVERY, AND LIMITED APPELLATE REVIEW AS COMPARED TO COURT LITIGATION. 1. Account Registration Certain areas of the Sites may require registration or may otherwise ask you to provide information in order to access certain features, such as to purchase products, to write product reviews, to receive electronic newsletters or mobile alerts, to participate in social networking activities, or to access our User Forums. The decision to provide this information is purely optional; however, if you elect not to provide such information, you may not be able to participate in certain features of the Sites. If you create a user account (“Account”), you agree to accept responsibility for all activities that occur under your Account, and you agree you will not sell, transfer or assign your rights to your Account to any third party. You are responsible for maintaining the confidentiality of your password and for restricting access to your computer (or other internet access device, as applicable) so that others may not access our Sites using your Account. Contrast E2C LLC reserves the right to terminate your Account or otherwise deny you access in its sole discretion without notice and without liability Furthermore, you are entirely responsible for any and all activities that occur under your Account. You agree to immediately notify our customer service department of any unauthorized use of your Account or any other breach of security of which you become aware. 2. Placing an Order Products and Services Offered on the Sites. If you wish to purchase any product or service made available through the Site, you may be asked to provide certain information relevant to your transaction including, without limitation, your credit or payment card number, the expiration date of your credit or payment card, your billing address, and your shipping information. YOU REPRESENT AND WARRANT THAT YOU HAVE THE LEGAL RIGHT TO USE ANY CREDIT OR PAYMENT CARDS OR OTHER PAYMENT METHODS UTILIZED IN CONNECTION WITH ANY TRANSACTION. By submitting such information, you grant to us the right to provide such information to third parties for purposes of facilitating the transactions initiated by you or on your behalf. You understand that we will not be liable in the event that others acting with or without your permission use your credit or payment card to make purchases on the Sites. Certain products that you purchase and/or download on or through the Sites may be subject to Additional Terms presented to you at the time of such purchase or download. Prices; Discounts. All prices listed on the Sites are subject to change. In the event a product or service is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, we shall have the right, prior to the acceptance of your order pursuant to our Order Acceptance Policy described below, to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit or payment card has already been charged for the purchase and we cancel your order, we shall issue a credit to your credit or payment card account in the amount of the charge. The nondiscounted prices displayed on our Sites are based on our subjective opinion of the value of the product, taking into account a number of factors such as item cost, profit margin, available inventory, anticipated demand, competition and prices of comparable products. The nondiscounted price is our offer price. This means that we offered the product or comparable products at the nondiscounted price. We may not have sold the product at the nondiscounted price in the recent past. Savings are calculated based on our nondiscounted price, not actual sales. Colors; Availability. Please keep in mind that while we might offer a variety of merchandise and other products and services for sale on the Sites, we cannot guarantee availability at a particular time; and certain products or services available at pop-up events might not be available on the Sites, and vice versa. We reserve the right to change our merchandise, media content and other products and service offerings, both at pop-up events and online, at any time. We also reserve the right to change contents, features and offerings, and adjust accessibility of the Sites from time to time in our discretion. Order Acceptance Policy. Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline your order for any reason. We may require additional verifications or information before accepting any order. Your order is not accepted until we send you shipping information for the order (or the accepted portion thereof). Notwithstanding the foregoing, you agree that, if we cancel all or a portion of your order, or if we provide you less than the quantity you ordered, your sole and exclusive remedy is either that (a) we will issue a credit to your credit or payment card account in the amount charged for the cancelled portion or the quantity not provided (if your credit or payment card has already been charged for the order) or (b) we will not charge your credit or payment card for the cancelled portion of the order or the quantity not provided. Payment Terms. For each product or service that you order on the Sites, you agree to pay the price applicable for the product or service (including any sales taxes, surcharges and any delivery fees for the delivery service you select) as of the time you submitted the order. Contrast E2C LLC will automatically bill your credit card or other form of payment submitted as part of the order process for such price. If payment is not received by your credit or payment card issuer or its agents, you agree to pay all amounts due upon demand by us. Sales Taxes. Sales taxes, or other taxes, duties, customs, import/export charges, or similar governmental charges are not included in the price of the products. We shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within the United States in accordance with our order policy in effect at the time of purchase. Each customer shall be solely responsible for all sales taxes, or other taxes, duties, customs, import/export charges, or similar governmental charges (except for taxes on Contrast E2C LLC’s net income), on orders shipped outside the United States. Exchange/Return Policy. All purchase transactions (excluding purchases for custom apparel) are subject to Contrast E2C LLC exchange/return policy in effect at the time of purchase. We may modify our return policies from time to time so you should check these each time prior to making a purchase. Please pay close attention to detail, spelling and color to ensure correct approval before printing custom apparel. Contrast E2C LLC will not refund or replace any item due to incorrect spelling, color or design. Prohibited Activities. You agree that you will not: (i) use any robot, spider, rover, scraper, or any other data mining technology or automatic or manual process to monitor, cache, frame, mask, extract data from, copy or distribute the Materials (except as may be a result of standard Internet browser or search engine); (ii) fail to follow the instructions provided on the Sites in a “robots.txt” file or similar mechanism (to the extent that you provide standard search engine services to the public); nor will you (iii) modify, frame, reproduce, archive, sell, lease, rent, exchange, create derivative works from, publish by hard copy or electronic means, publicly perform, display, disseminate, distribute, broadcast, retransmit, circulate to any third party or on any third-party web site, or otherwise use the Materials in any way for any commercial purpose. 6. Information You Submit; Privacy Policy (a) User Content. The Sites may provide you and others with the opportunity to participate in forums, blogs, message boards, product reviews, social networking, and other communication (collectively, “User Forums”) and may provide you with the opportunity, through such features or otherwise, to submit, post, display, transmit, perform, publish, distribute or broadcast content and materials to Contrast E2C LLC or the Sites, including, without limitation, photographs, writings, music, video, audio recordings, computer graphics, pictures, data, questions, comments, suggestions or personally identifiable information (collectively, “User Content”) Privacy Policy. Any User Content or other personal information you provide to Contrast E2C LLC will be subject to our Privacy Policy. If you do not agree to these terms, stop accessing or using the Services and see information below about your rights. CONTRAST E2C LLC AND ALL ASSOCIATED SERVICES AND SYSTEMS ARE DIRECTED TO RESIDENTS OF THE UNITED STATES AND HOUSED ON SERVERS IN THE UNITED STATES. IF YOU ARE LOCATED OUTSIDE OF THE UNITED STATES, INFORMATION WE COLLECT (INCLUDING COOKIES) IS PROCESSED AND STORED IN THE UNITED STATES, WHICH MAY NOT OFFER THE SAME LEVEL OF PRIVACY PROTECTION AS THE COUNTRY WHERE YOU RESIDE OR ARE A CITIZEN. BY USING THE SERVICES AND PROVIDING INFORMATION TO US, YOU CONSENT TO THE TRANSFER TO AND PROCESSING OF YOUR INFORMATION IN THE UNITED STATES. I. WHAT INFORMATION DO WE COLLECT? We collect: Personal identifiers, such as your name, date of birth, gender, phone number, email address, and postal address. If you have created an account with Contrast E2C LLC, we also collect your account number, username and password, and similar data. Financial and commercial information, such as your payment card number, billing address, expiration date, and related financial information. We also collect transaction information such as purchasing history with Contrast E2C LLC. Audio, electronic, and visual information, such as photos and other information you post on our Sites or Apps. This also includes information you provide from your social networking sites, such as social media account ID, profile photo, and other data made available when you choose to link your social media accounts. We also collect communications between you and Contrast E2C LLC. Communications between you and Contrast E2C LLC (whether in written, audio, or video format), including, but not limited to, questions or comments submitted by you to our customer service department (through phone, email, live chat, automated chat, or otherwise), as part of an interactive event or feature, or in connection with product reviews (including any photographs you submit as part of a product review). Geolocation information from your IP address, which links to the region you live in, or shares your location with us if your location settings on your device are set to share. The information described above shall be collectively referred to as “Personal Information.” II. WHERE DO WE COLLECT INFORMATION FROM? For example, the Services may give you the option to link to your Facebook or other social media account, follow us, or share content on our account, your account, or your friends’ account. Based on the way you have set your privacy settings on your social media accounts, most social media platforms, like Facebook, analyze data about how you interact with our Services and combine it with information on other users to provide us information about your name, profile name, demographic information, contact information, region, interests, and usage data. In addition, we may receive information about you if other users interact with us on social media and information about you is visible to us, for example the fact that you are “friends” or other public-facing profile information. Business partners, if they either have your consent or another legal basis to share your information with us. If you provide your Personal Information to other businesses, we do not control how they treat your information and are not responsible for their conduct. For Sites and Apps functionality. Enable you to: (i) participate in a variety of features on our Sites or Apps, such as sweepstakes, message boards, customer support, other communication features like live and automated chat, user-generated content functions, and interactive features; and (ii) invite friends to use our Services, for example when you send someone else a communication through the Services, like an invitation to a friend, we use the information you provide (e.g., your friend’s name and e-mail address) to send the invite. For security and fraud prevention. Conduct vendor due diligence and protect our Sites, Apps, premises, networks, assets, systems, products, Services, and intellectual property from fraud, theft, and other misconduct. For legal purposes. Comply with our legal obligations, including reporting requirements; defend ourselves in legal proceedings; and protect our company and our property, employees, and others through legal proceedings. Payment Processing. We use third party payment processors to assist with securely processing your payment information. If you pay with a credit card or other form of electronic payment, the payment information that you provide through the Services is encrypted and transmitted directly to the payment processor. We do not store your payment information and do not control and are not responsible for the payment processor or its collection or use of your information. We do not direct the Sites or Apps to, nor do we knowingly collect any Personal Information from, children under the age of 13. To determine the appropriate retention period for Personal Information, we consider the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the purposes for which we process your Personal Information and whether we can achieve those purposes through other means, and the applicable legal requirements. We hope you love what you’ve ordered, but if there’s an issue or you’re not 100% satisfied – contact us to initiate a return of your item (in person or via shipment). Please note: all custom orders delivered/accepted by the buyer are not able to be returned/non-refundable. All returns should be initiated within 30 days of delivery (in person sales) or shipment date. Please save the invoice you received with your package. It’s your receipt in case you need to return your item(s). Once your return has been received, please allow 1-2 weeks for processing and 3-7 business days to receive your credit. Contrast E2C LLC is not responsible for lost or damaged packages by shipment/delivery services.
